IP as an Artist's Conceit

The issue of an artist's exploitation is at the heart of this piece. There is the artist who doesn't get compensated for his work. And then there is the appropriation of black music glam for the video. There are a lot of issues in here.

"Bobby Farell realized many people, if they had been in his position, would probably have regrets."

  1. Many issues indeed, and difficult to trace to a single root; perhaps a first question could be: what should be the compensation for artistic output, and who should control that compensation?

On the one hand, it seems obvious that all ideas are to some degree inspired by something else, are derived from something pre-existing, establishing a fundamental collaborative nature of things, but this nature doesn't mean that a new twist doesn't occur —who/what should be compensated for a twist? Does the degree or amount of twisting factor? How is the twist factor determined? At which point does amount of twist establish something more new than derived? Etc.

As long as a capitalist system prevails, there is a need for income, so equitable rules of twist and derivation compensation seem necessary within capitalist systems though capitalist systems themselves may be problematic and do not seem designed to seek, establish or maintain equitable compensation which is an ambition of Limited Fork Theory.
